What Types of Sex Crimes Require Sex Offender Registration in Dayton, Ohio?
The laws governing the sex offender registry in Dayton, Ohio, changed in 2008 when the Adam Walsh Act (AWA) was implemented. The law eliminated pre-AWA terms like “child sexual predator” and implemented the following three registry tiers as defined by the Ohio Attorney General’s Guide to Ohio’s SORN Laws:
Tier I
Tier I is the lowest tier with the lowest burdens and the shortest term. A Tier 1 sex offender in Ohio is subject to the following restrictions:
- Annual in-person verification
- 15-year registration term
This tier includes the least serious sex offenses subject to registration, including the following:
- Gross sexual imposition and sexual imposition
- Importuning
- Voyeurism
- Promoting prostitution
- Pandering obscenity
- Unlawful sexual conduct with a minor
- Illegal use of a minor or impaired person in nudity-oriented material or performance
- Menacing by stalking
- Unlawful restraint
- Criminal child enticement
- Public indecency
This tier typically includes first offenders and offenses against adults, although a few child-based offenses are included.
Tier II
Tier II offenders are subject to stricter requirements, including the following:
- Semi-annual in-person verification
- 25-year registration term
A conviction for any of the following offenses will require registration as a Tier 2 sex offender in Ohio:
- Compelling prostitution
- Pandering obscenity involving a minor or impaired person
- Pandering sexually-oriented matter involving a minor or impaired person
- Unlawful sexual conduct with a minor where the age gap is over four years
- Sexual battery involving sexual contact
- Kidnapping of an adult for sexual purposes
- Gross sexual imposition against a victim under 13
- Sexually-motivated abduction
- Child endangerment
- Human trafficking
The offenses on Tier II often, but not always, involve children or violence. It also includes repeat offenders who have previously been convicted of a sexual offense and classified as Tier I offenders. Finally, it includes offenders who committed an offense before 2008 and were classified as a pre-AWA habitual sex offender or habitual child-victim offender.
Tier III
A Tier 3 sex offender in Ohio is the strictest level with the following characteristics:
- Quarterly in-person verification
- Lifetime registration
Offenses on this tier include the following:
- Rape
- Sexual battery involving sexual conduct
- Kidnapping of a victim under 18 for sexual purposes
- Kidnapping by anyone not a parent of a victim under 18 in a way that endangers them
- Gross sexual imposition involving molestation of a child under 12
- Aggravated murder, murder, or felonious assault with a sexual motivation
- Voluntary manslaughter with a sexual motivation
- Involuntary manslaughter occurring while committing a sexually motivated felony
Tier III includes the most severe offenses eligible for registration. This tier also includes anyone classified as a pre-AWA sexual predator. What does pre-AWA sexual predator mean? It simply means the person was convicted before the AWA of any of the offenses included in Tier III.
