It also includes repeat offenders who have previously been convicted of a sexual offense and classified as Tier I offenders. Finally, it includes offenders who committed an offense before 2008 and were classified as a pre-AWA habitual sex offender or habitual child-victim offender.

Tier III

A Tier 3 sex offender in Ohio is the strictest level with the following characteristics:

  • Quarterly in-person verification
  • Lifetime registration

Offenses on this tier include the following:

  • Sexual battery involving sexual conduct
  • Kidnapping of a victim under 18 for sexual purposes
  • Kidnapping by anyone not a parent of a victim under 18 in a way that endangers them
  • Gross sexual imposition involving molestation of a child under 12
  • Aggravated murder, murder, or felonious assault with a sexual motivation
  • Voluntary manslaughter with a sexual motivation
  • Involuntary manslaughter occurring while committing a sexually motivated felony

Tier III includes the most severe offenses eligible for registration. This tier also includes anyone classified as a pre-AWA sexual predator. What does pre-AWA sexual predator mean? It simply means the person was convicted before the AWA of any of the offenses included in Tier III.

A sex offender must appear in person at the local sheriff’s office to register. Someone else cannot register for them. Similarly, family members, neighbors, or even victims cannot simply put someone on the registry. Instead, the only way to appear on the registry is a conviction for a sex offense.

How often must a registered sex offender verify their registration information?

The frequency of a registrant’s verification requirement depends on the tier level assigned to them. Tier 1 registrants verify annually, Tier II registrants verify semi-annually, and Tier III registrants verify quarterly. The tier also determines how long the registrant must register.
