Assault and Domestic Violence Charges Dramatically Reduced

CHARGES

  • Domestic Violence and Assault

DESCRIPTION OF CASE

Our client was charged with both Domestic Violence and Assault after law enforcement was called to his home by his highly intoxicated spouse. Officers investigated by speaking to all parties and documenting the scene. Despite the absence of visible injuries, signs of physical struggle, or any corroborating physical evidence, our client was cited for two offenses of violence — charges that carried serious consequences for his career, his security clearance, and the divorce proceedings he was simultaneously navigating.

Upon being retained, our attorneys moved immediately and aggressively to secure all available evidence, including police reports, the 911 call recording, and scene photographs. Recognizing that critical footage could be lost or overwritten, we filed a motion with the court to preserve all video evidence. The judge granted our motion, and we successfully obtained both police body camera footage and recordings from the home’s own security camera system. What had begun as a classic “he said/she said” case was transformed by that footage into something far more concrete. Once we presented the totality of the evidence to the prosecutor, the State agreed to a dramatic reduction of both charges to a single minor misdemeanor — Disorderly Conduct — with no offense of violence on our client’s record.

LEGAL REPRESENTATION

This case underscores a fundamental principle of effective criminal defense: law enforcement does not always secure every piece of evidence that matters, and it is the defense attorney’s job to find it first. The home security camera footage was the turning point in this case. Without it, our client faced two violent offense charges that would have permanently damaged his federal security clearance and derailed his career. By moving quickly to preserve that evidence and building a comprehensive picture of what actually occurred, we were able to deliver a resolution that protected our client’s livelihood, his professional standing, and his future. We will also be pursuing a record sealing on his behalf when he becomes eligible, ensuring that this matter does not follow him beyond this chapter of his life.
