How Do I Obtain a Divorce in the State of Ohio?

There are two elements that must be determined before you can file for divorce in Ohio. The first is to determine the appropriate jurisdiction. The court will need to find that the plaintiff has fulfilled the following requirements:

  • Resident of Ohio for a minimum of six months immediately prior to filing the complaint
  • Resident of the county in which the divorce was filed for at least 90 days

Grounds for divorce will then need to be determined. The party who is filing must have legal reasons for the court to grant the divorce. Ohio law allows divorce when one of the statutory grounds to terminate the marriage can be proven. There must be testimony by the plaintiff and a corroborating witness as to the specific grounds. In this state, grounds for divorce can include:

  • Incompatibility
  • Living separate and apart without cohabitation for one year
